In dismissing the complaint, the prosecutors office ruled any personal transaction Nicko Falcis made with the credit card Aquino said was the card of her company Kris Cojuangco Aquino Productions did not constitute theft.
For this, the prosecutor noted the credit card in question was under the name of Falcis.
The prosecutor also noted there was no proof of the supposed agreement between Falcis and Aquino that the card was the company’s.
“It is for this reason that Falcis’ name appears in the credit cards statement of account. Thus, should Falcis now pay his credit card bill, BDO can directly initiate legal actions against him to compel him to pay,” the prosecutors office said.
Aquino has accused Falcis of stealing over a P1 million from the KCAP funds by using the credit card to make unauthorized purchases.
